  • Delays: While we strive to ensure timely delivery, SKAC is not responsible for delays caused by unforeseen circumstances, such as weather conditions, customs clearance, or courier service issues.

9. Returns & Cancellations

Return Policy

SKAC is committed to ensuring customer satisfaction with our products. However, we do not offer refunds for products once they have been sold. If the product is damaged during shipping, we will exchange it, provided you send us a video recording of the product while opening it. Also, items must be unused, in their original condition, and include all original packaging and tags.

  • Return Process: To initiate a return, please get in touch with our customer service team with your order number and reason for return. You will receive instructions on how to return your item(s).

Cancellation Policy

  • Order Cancellations: You may cancel your order for a full refund if it has not yet been processed or shipped. Once an order has been processed, it cannot be cancelled.

These Terms & Conditions and any disputes arising out of or related to the use of the SKAC website or services shall be governed by and construed in accordance with the laws of India without regard to its conflict of law principles.

Jurisdiction

You agree that any legal action or proceeding between you and SKAC for any purpose concerning these Terms or the parties’ obligations hereunder shall be brought exclusively in a court of competent jurisdiction located in Bangalore, India. You consent to the jurisdiction of and venue in such courts and waive any objection to the laying of venue of any such litigation.

12. Dispute Resolution

Negotiation and Mediation

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of the SKAC services, the parties agree to first attempt to resolve the issue through informal negotiation. If the dispute cannot be resolved through negotiation, the parties agree to participate in mediation with a neutral third party before pursuing any other legal remedies.

Arbitration Agreement

If the dispute cannot be resolved through negotiation or mediation, the parties agree that any remaining dispute shall be resolved by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India. The arbitration shall be conducted in Bangalore, India, in the English language. The arbitrator’s decision shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. By entering into this agreement, you waive any right to participate in a class action lawsuit, class-wide arbitration, or any other representative proceeding.

13. Termination

Termination by SKAC

SKAC reserves the right, at its sole discretion, to terminate your account and your access to the website or services, with or without cause and without prior notice, for any reason, including but not limited to a violation of these Terms.

  • Effect of Termination: Upon termination, your right to use the services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Termination by User

You may terminate your account at any time by following the instructions on the SKAC website or by contacting our customer service team. Termination does not relieve you of any obligations under these Terms, including any payment obligations for orders already placed.

15. Miscellaneous Provisions

Entire Agreement

These Terms & Conditions, together with our Privacy Policy and any other legal notices published on our website, constitute the entire agreement between you and SKAC regarding the use of our services. Any other agreements, understandings, or representations, whether oral or written, are superseded by these Terms.

Severability

SKAC shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of war, terrorism, labor disputes, internet service interruptions, or government actions.

Assignment

You may not assign or transfer your rights or obligations under these Terms without the prior written consent of SKAC. SKAC may assign or transfer its rights and obligations under these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.
